Spheres (hereinafter referred to as the "Company") sets forth this Privacy Policy (hereinafter referred to as "this Policy") regarding the handling of users' personal information in the services provided on this website (hereinafter referred to as the "Service") as follows.
Article 1 (Personal Information)
"Personal Information" refers to "personal information" as defined in Japan's Act on the Protection of Personal Information, meaning information relating to a living individual that can identify a specific individual by name, date of birth, address, telephone number, contact details, or other descriptions contained in such information, as well as data relating to physical appearance, fingerprints, voiceprints, and individual identification codes (such as the insurer number on a health insurance card) that can identify a specific individual from such information alone.
Article 2 (Method of Collecting Personal Information)
The Company may ask Users for personal information, such as their email address, when they register for use. In addition, the Company may collect transaction records and information related to payments, including Users' personal information, from the Company's business partners (including information providers, advertisers, and ad distribution destinations; hereinafter referred to as "Partners").
Article 3 (Purpose of Collecting and Using Personal Information)
The purposes for which the Company collects and uses personal information are as follows:
- To provide and operate the Company's services;
- To respond to inquiries from Users (including verifying the User's identity);
- To send necessary communications such as maintenance notices and important updates;
- To identify Users who have violated the Terms of Service or who intend to use the Service for fraudulent or wrongful purposes, and to refuse their use;
- To allow Users to view, modify, or delete their registration information, and to view their usage status;
- To bill Users for usage fees in paid services;
- For purposes incidental to the above.
Article 4 (Change of Purpose of Use)
- The Company shall change the purpose of use of personal information only when it is reasonably deemed that the purpose of use after the change is related to that prior to the change.
- In the event of a change to the purpose of use, the Company shall notify Users of the revised purpose by the method prescribed by the Company, or announce it on this website.
Article 5 (Provision of Personal Information to Third Parties)
- Except in the following cases, the Company will not provide personal information to a third party without obtaining the prior consent of the User, unless permitted under the Act on the Protection of Personal Information or other laws and regulations:
- When it is necessary for the protection of a person's life, body, or property, and it is difficult to obtain the consent of the individual;
- When it is particularly necessary for improving public health or promoting the sound development of children, and it is difficult to obtain the consent of the individual;
- When it is necessary to cooperate with a state organ, a local government, or a person entrusted by either in executing affairs prescribed by laws and regulations, and obtaining the consent of the individual is likely to impede the execution of such affairs;
- When the following matters have been notified or announced in advance, and the Company has submitted a notification to the Personal Information Protection Commission:
- The purpose of use includes provision to third parties;
- The items of personal data to be provided to third parties;
- The means or method of provision to third parties;
- The cessation of provision of personal information to third parties upon request of the individual;
- The method for accepting such requests from the individual.
- Notwithstanding the preceding paragraph, in the following cases the recipient of such information shall not be deemed a third party:
- Where the Company entrusts all or part of the handling of personal information within the scope necessary to achieve the purpose of use;
- Where personal information is provided in connection with the succession of business due to a merger or other reasons;
- Where personal information is jointly used with a specific party, and the individual has been notified in advance of that fact, together with the items of personal information jointly used, the scope of joint users, the purpose of use by such users, and the name of the person responsible for managing the personal information, or such information has been made readily accessible to the individual.
Article 6 (Disclosure of Personal Information)
- When requested by an individual to disclose their personal information, the Company shall disclose it to the individual without delay. However, if disclosure falls under any of the following items, the Company may decide not to disclose all or part of the information, and if such a decision is made, the Company will notify the individual without delay. A processing fee of 1,000 yen per request will be charged for the disclosure of personal information:
- If there is a risk of harming the life, body, property, or other rights and interests of the individual or a third party;
- If there is a risk of significantly hindering the proper execution of the Company's business;
- If it would otherwise violate laws and regulations.
- Notwithstanding the preceding paragraph, in principle, information other than personal information, such as history information and characteristic information, will not be disclosed.
Article 7 (Correction and Deletion of Personal Information)
- If a User's personal information held by the Company is inaccurate, the User may request that the Company correct, add to, or delete (hereinafter referred to as "Corrections, etc.") the personal information in accordance with the procedures established by the Company.
- If the Company receives a request from a User under the preceding paragraph and determines that it is necessary to respond to that request, the Company shall make such Corrections, etc. to the relevant personal information without delay.
- If the Company has made Corrections, etc. pursuant to the preceding paragraph, or has decided not to make Corrections, etc., the Company shall notify the User thereof without delay.
Article 8 (Suspension of Use, etc. of Personal Information)
- If the Company is requested by an individual to suspend the use of, or erase (hereinafter referred to as "Suspension of Use, etc."), their personal information on the grounds that it is being handled beyond the scope of the purpose of use, or that it was acquired through wrongful means, the Company shall conduct the necessary investigation without delay.
- If, based on the results of the investigation in the preceding paragraph, the Company determines that it is necessary to comply with the request, the Company shall carry out the Suspension of Use, etc. of the personal information without delay.
- If the Company has carried out Suspension of Use, etc. pursuant to the preceding paragraph, or has decided not to do so, the Company shall notify the User thereof without delay.
- Notwithstanding the preceding two paragraphs, if Suspension of Use, etc. would require substantial expense or is otherwise difficult to implement, and alternative measures can be taken to protect the rights and interests of the User, the Company shall take such alternative measures.
Article 9 (Changes to this Privacy Policy)
- The contents of this Policy may be changed without notice to Users, except as otherwise provided by laws, regulations, or this Policy.
- Unless otherwise specified by the Company, the revised Privacy Policy shall take effect from the time it is posted on this website.
